AI-Assisted Prior Authorization: What CMS Rules on Payer AI Mean for Your Contracts

Status: Draft

AI-assisted prior authorization can speed payer decisions, but speed does not make every denial sound. For your provider enrollment and payer enrollment operations, accurate provider data and a disciplined appeal process are essential as CMS requirements phase in.

What CMS-0057-F changes

The CMS Interoperability and Prior Authorization Final Rule (CMS-0057-F) sets new requirements for certain health plans, including Medicare Advantage organizations and Medicaid and CHIP programs. The rule’s operational changes generally began in 2026; API requirements generally begin in 2027. Dates vary by payer type, rating period, and plan year, so confirm the timeline for each payer. The rule’s prior authorization provisions discussed here do not apply to drugs.

For applicable non-drug requests, impacted payers, excluding Qualified Health Plan issuers on federally facilitated exchanges for these timeframes, must issue decisions within 72 hours for expedited requests and seven calendar days for standard requests. Denials must include a specific reason.

Beginning in 2027, applicable payers must implement a standards-based FHIR Prior Authorization API. It is designed to communicate whether authorization is required, identify documentation requirements, and return an approval, denial with a specific reason, or request for more information. See CMS’s summary of the final rule.

What CMS says about AI in Medicare Advantage

CMS-0057-F does not impose a universal ban on payer AI or require human review of every AI-assisted decision. Separate CMS guidance on Medicare Advantage coverage decisions says plans may use algorithms and AI to assist, but must base medical-necessity decisions on the individual patient’s circumstances and applicable coverage criteria.

CMS says an algorithm alone cannot serve as the basis for denying an inpatient admission or downgrading it to observation. When an MA plan expects to issue an adverse medical-necessity decision, CMS guidance also calls for review by a physician or other appropriate health professional with relevant expertise before the decision is issued. Review the CMS FAQ on coverage criteria and utilization management, and consult counsel about how the requirements apply to your contracts and cases.

Veracity Take: Prepare your workflow and contracts

Faster decision windows shorten the time your team has to spot missing information and respond. API-based transactions also depend on clean, consistent provider and practice data. A mismatch in an identifier, taxonomy, or location can disrupt a request before clinical review begins.

The rules do not automatically rewrite your payer agreements. Review contract language and operating procedures for response timelines, escalation contacts, notice requirements, and appeal steps. Then put these four controls in place:

  1. Track denial reasons. Record the payer’s stated reason and relevant codes, where provided, so you can identify recurring patterns.
  2. Build policy-based appeal templates. Organize templates around payer policies and common documentation gaps; tailor every appeal to the patient’s record.
  3. Verify provider data. Check identifiers, taxonomy, practice locations, and enrollment records before relying on API workflows.
  4. Review payer policies quarterly. Document changes to coverage rules, submission requirements, and appeal processes.

For the broader onboarding controls that support accurate payer records, see Veracity’s provider onboarding checklist.

CMS timelines are phasing in, and payer obligations differ. Confirm the applicable dates and terms for every plan. In an AI-enabled authorization process, clean data helps the request move; a specific denial reason helps your team decide what to do next.
